This Supplemental/Bid Bulletin is issued to inform all prospective bidders of the following changes in the Bidding Rules / Instruction to Bidders in reference to Commission on Audit (COA) and Department of Budget and Management (DBM) Joint Circular No. 1 series of 2024 on the Revised Manual on the Disposal of Government Properties, to wit:

| 4. There is a failure of public bidding in any of the following instances:
a. If there are no bids received or there is only one offeror. In this case, the offer or bid, if sealed, shall not be opened; b. If all the offers/tenders are non-complying or unacceptable;
A tender is non-complying or unacceptable when it does not comply with the prescribed legal, technical and financial requirements for pre-qualification.

4. Failure of public auction shall be declared under any of the following cases:
a. No auctions were received; or b. All bidders failed to comply with the terms and conditions prescribed in the invitation to bid.

| · Duly accomplished Bid Form;
· Bid Bond amount equivalent to at least ten percent (10%) of the Total Bid Offer in the form of cash, cashier’s check or manager’s check |
· Duly accomplished Bid Form;
· The auction/bid bond shall accompany the auction tender equivalent to at least 10% of the minimum auction price set by the government. Auction bonds may be in the form of cash or manager’s/cashier’s check from a commercial or universal bank. In cases where tenders are paid electronically, proof of cash payment for the auction bond shall be allowed. |
